1. Introducción

These Insurance Terms of Business set out the basis upon which HolaSpain (“we”, “us”, “our”) provides insurance intermediation services. By purchasing or enquiring about an insurance product through HolaSpain, you agree to the terms outlined below.

2. Regulatory Status

HolaSpain is a company registered in Ireland and acts as an insurance intermediary in relation to selected international student insurance products. We distribute specific insurance products arranged with authorised insurance providers; we do not provide a personal recommendation based on a full market analysis, and our services should not be interpreted as independent financial advice.

3. Scope of Our Insurance Services

Our role is limited to providing information about selected insurance products, facilitating policy issuance, and assisting with documentation related to insurance coverage.

4. Insurance Providers

Insurance policies arranged through HolaSpain are underwritten by authorised insurance companies. Policy terms, coverage limits, exclusions, and claims handling procedures are governed exclusively by the insurer, and the insurer’s documentation will prevail in the event of any inconsistency.

5. Duty of Disclosure

You are responsible for providing complete, accurate, and truthful information when applying for insurance. Failure to disclose relevant information may invalidate your policy, result in refusal of a claim, or lead to cancellation of coverage in accordance with the insurer’s terms.

6. Premiums & Payments

Insurance premiums must be paid in full prior to policy issuance unless otherwise agreed in writing. Coverage does not commence until payment has been received and the policy has been issued (or otherwise confirmed by the insurer).

7. Remuneration & Commission Disclosure

HolaSpain may receive remuneration in the form of commission from the insurance provider. This commission is included within the insurance premium and does not increase the price paid by the customer beyond the agreed premium. We do not charge separate advisory fees unless explicitly disclosed in writing prior to purchase.

8. Conflicts of Interest

HolaSpain maintains internal policies to manage potential conflicts of interest. If a conflict arises that could materially affect your interests, we will disclose it in writing where required.

9. Policy Documentation

Upon issuance, you will receive a Certificate of Insurance, the Insurance Product Information Document (IPID), and full policy wording (or access to the full policy wording). It is your responsibility to read and understand the policy documentation, including coverage limits, exclusions, conditions, and claim procedures.

10. Claims Handling

All insurance claims must be submitted directly to the insurer or its appointed claims administrator in accordance with the policy documentation. HolaSpain does not assess, approve, or reject claims. We may provide reasonable administrative assistance (for example, helping you locate the correct claims channel), but claims decisions remain exclusively with the insurer.

11. Cancellation Rights

Insurance cancellation rights are governed by the insurer’s policy terms and applicable consumer protection laws. Depending on the policy type and circumstances, you may have a statutory cooling-off period. Any refund (where permitted) is subject to the insurer’s terms and may be reduced by applicable charges in accordance with the policy documentation.

12. Data Protection

Personal data collected for insurance purposes is processed in accordance with our Privacy Policy. Relevant data will be shared with insurers, underwriters, and authorised partners strictly for policy issuance, administration, and claims handling, and only to the extent necessary.

In accordance with Irish Anti-Money Laundering legislation, we may request identity verification documentation, conduct risk-based compliance checks, refuse or delay transactions pending verification, and report suspicious transactions to competent authorities as required by law. Failure to comply with verification requirements may result in refusal of service or cancellation of a transaction.

14. Complaints Procedure

If you wish to make a complaint regarding our insurance intermediation services, please contact us in writing at info@holaspain.agency. We will acknowledge your complaint and aim to resolve it promptly. If you remain dissatisfied, you may refer your complaint to the appropriate regulatory authority or the Financial Services and Pensions Ombudsman (FSPO) in Ireland, where eligible.

15. Limitation of Liability

HolaSpain’s liability is limited to losses directly arising from our proven negligence in the provision of insurance intermediation services. We are not liable for insurer insolvency, claim rejection by the insurer, or policy exclusions clearly stated in the documentation, nor for any indirect or consequential losses.

16. Derecho aplicable

These Insurance Terms of Business are governed by the laws of Ireland, and any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
