1. Introdução
These Group & Sports Programme Terms govern participation in any group travel, school trip, cultural immersion, sports training, tournament, or related programme organised or coordinated by HolaSpain (“we”, “us”, “our”). By registering for a group or sports programme, participants, parents/guardians, and sending organisations agree to these Terms.
2. Nature of HolaSpain’s Role
HolaSpain acts as programme coordinator and intermediary between participants and third-party service providers, including sports clubs, training facilities, accommodation providers, transport operators, and educational institutions. HolaSpain is not the direct provider of sporting instruction, medical care, transport services, or accommodation.

3. Assumption of Risk
Participation in sports and physical activities involves inherent risks, including but not limited to physical injury, illness, accidents during training or competition, and travel-related incidents. Participants voluntarily assume all risks associated with participation in the programme.

4. Medical Fitness & Disclosure
Participants must be medically fit to participate, disclose any relevant medical conditions, and provide emergency contact information. Failure to disclose relevant medical information may result in exclusion from participation and may invalidate insurance coverage.

5. Insurance Requirement
All participants must hold valid travel and medical insurance covering sports participation, medical emergencies, and repatriation. HolaSpain may facilitate insurance arrangements but is not responsible for claims decisions, coverage determinations, or insurer outcomes.

6. Responsibility of Sending Organisation
Where a group is organised by a school, club, academy, or other organisation, that organisation remains fully responsible for supervision of participants, behaviour and discipline, safeguarding minors, and compliance with local laws. HolaSpain does not assume custodial responsibility for minors unless explicitly agreed in writing.

7. Code of Conduct
Participants must respect local laws, follow safety instructions, respect coaches, staff, and accommodation rules, and avoid dangerous or unlawful behaviour. Serious misconduct may result in immediate removal from the programme without refund and without further liability to HolaSpain.

8. Limitation of Liability
HolaSpain shall not be liable for injuries sustained during sporting activities, acts or omissions of third-party providers, loss of personal belongings, travel delays or disruptions, or force majeure events. Liability is limited to proven gross negligence directly attributable to HolaSpain. In all cases, maximum liability shall not exceed the administrative fees paid to HolaSpain for the relevant programme.

9. Medical Emergencies
In the event of a medical emergency, participants authorise emergency medical treatment, hospitalisation if required, and contact with emergency contacts. All associated costs remain the responsibility of the participant or their insurer, and HolaSpain is not responsible for medical decision-making by healthcare providers.

10. Travel & Accommodation
Accommodation and transport services are provided by independent third parties. HolaSpain is not responsible for service failures beyond its reasonable control, including provider changes, cancellations, delays, or disruptions.
11. Cancellation – Individual Participants
Cancellation terms for individual participants are subject to provider cancellation policies, confirmed bookings, and any non-refundable deposits or pre-paid services already committed on the participant’s behalf.

12. Cancellation – Groups
Group bookings may require a non-refundable deposit. Cancellation charges may apply depending on the notice period and contractual commitments made with providers, including accommodation blocks, facility hire, transport reservations, staffing, and prepaid services. Certain payments made to third-party providers may be non-recoverable.
13. Force Majeure
HolaSpain shall not be liable for programme cancellation or modification due to circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, government restrictions, war or civil unrest, and transport disruptions. In such cases, refunds (if any) depend on supplier recovery and contractual obligations.

14. Photography & Media
During programmes, photographs or videos may be taken for operational and promotional purposes. By participating, you consent to such use unless you notify us in writing prior to the programme. Where required by law (for example, for minors), additional consent may be requested from a parent or guardian.
15. Data Protection
Personal data collected for programme participation is processed in accordance with our Privacy Policy and may be shared with relevant third-party providers strictly for programme delivery and safeguarding purposes.

Estes Termos são regidos pelas leis da Irlanda, e quaisquer disputas estarão sujeitas à jurisdição exclusiva dos tribunais irlandeses.
