2. Company Status

HolaSpain is a company registered in Ireland and acts solely as an intermediary between students and educational institutions, participants and programme providers, and clients and insurance companies. HolaSpain is not a school, university, accommodation provider, sports club, or insurance underwriter.

3. Scope of Services

4. Contract Formation

A booking is confirmed only when the Student confirms acceptance in writing, the required payment is received, and the relevant educational institution or provider confirms availability. Until these conditions are met, no binding contract is formed.

5. Payments

Payments may include tuition fees, registration fees, accommodation fees, insurance premiums, and administrative fees. Payment deadlines must be strictly respected, and failure to pay on time may result in cancellation of services or loss of reserved places.

6. Insurance Services

Where insurance is arranged through HolaSpain, we act as intermediary only. The policy is governed exclusively by the insurer’s terms and conditions, and claims must be handled directly with the insurer. HolaSpain does not provide independent insurance advice on the full market and may receive commission included within the premium.

7. Visa Disclaimer

HolaSpain may provide general guidance regarding visa procedures; however, we do not guarantee visa approval, provide legal immigration advice, or accept responsibility for visa refusals. Visa decisions remain exclusively at the discretion of the relevant immigration authorities.

8. Cancellation & Refunds

8.1 Educational Programmes

Cancellation terms are governed by the policies of each educational institution. Registration fees are generally non-refundable unless explicitly stated otherwise.

8.2 Visa Refusal

Refunds may be available upon provision of official written visa refusal documentation, subject to the individual school’s policy and any non-recoverable administrative costs.

8.3 Insurance

Insurance cancellation is governed strictly by the insurer’s terms and conditions. HolaSpain cannot override insurance contract terms or guarantee refund eligibility.

9. Group & Sports Programmes

9.1 Assumption of Risk

Participation in sports or group activities involves inherent physical risks. Participants acknowledge and accept these risks and agree that they participate voluntarily.

9.2 Responsibility of Sending Organisation

Where a group is organised by a school, club, or third party, that organisation remains responsible for supervision, discipline, safeguarding, and participant conduct.

9.3 Medical Disclosure

Participants must disclose relevant medical conditions prior to participation. Failure to disclose may invalidate insurance coverage or participation rights.

9.4 Liability Limitation for Activities

HolaSpain shall not be liable for injuries, accidents, or losses arising from participation in sports or recreational activities except in cases of proven gross negligence directly attributable to HolaSpain.

10. Participant Conduct

Students and participants must comply with local laws, respect school rules, respect accommodation rules, and behave appropriately during programmes. Serious misconduct may result in termination of participation without refund.

11. Limitation of Liability

HolaSpain shall not be liable for acts or omissions of third-party providers, force majeure events, visa refusals, travel disruptions, or indirect or consequential losses. Our maximum liability shall be limited to the administrative fees received by HolaSpain for the relevant booking.

12. Force Majeure

HolaSpain shall not be liable for failure to perform obligations due to events beyond reasonable control, including natural disasters, pandemics, government actions, war or civil unrest, and transport disruptions.

14. Data Protection

All website content, branding, and materials remain the intellectual property of HolaSpain. Unauthorised reproduction, distribution, or commercial use is prohibited.

16. Complaints Procedure

Complaints should be submitted in writing to info@holaspain.agency. We aim to respond within a reasonable timeframe in accordance with our published Complaints Procedure.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of Ireland, and any disputes shall be subject to the exclusive jurisdiction of the Irish courts.

HolaSpain reserves the right to amend these Terms at any time. Updated versions will be published on this page and will take effect upon publication.
